CECA assisted contractors
involved in preparing claims and termination settlement proposals for the $11 Billion
Superconducting Super Collider Project in Texas. The three major projects CECA was
involved in was an open cut tunnel project, a TBM tunnel project and a building project.
Below is a discussion of the open cut tunnel project which CECA was hired to prepare and
negotiate claims.
The open cut tunnel construction project was performed by Cajun Contractors, Inc. The
project was awarded in the amount of $8,560,000 and consisted of approximately 50,000 cy
of rock excavation, 30,000 cy of clay excavation, 2,300 cy of 6000 PSI concrete and 7,400
cy of 8000 PSI concrete, 10 pre-engineered buildings, electrical utilities and
miscellaneous gas, water, PVC, stainless steel, HDPE and dual containment piping.
The project was suspended twice and thirteen (13) unilateral change orders were issued by
the Owner's representative for pricing and negotiation at a later date. The contractor
encountered numerous constructive suspensions throughout the project. The project was
constantly being redesigned. Prior to the negotiation of the 13 unilateral change orders,
the contract was terminated for the convenience of the government when the original scope
of work was 85% complete.
CECA was hired by the contractor to (1) prepare the termination settlement proposal, (2)
price out the 13 unilateral change orders, (3) calculate the delay and suspension damages,
(4) calculate the loss of productivity costs, and (5) prepare a profit analysis to show
that the contractor would not have been in a loss position had the contract gone to
completion.
CECA also assisted in the termination inventory process, which involved preparing
termination inventory forms and assisting the government in the verification of the
inventory.
CECA reviewed the subcontractor and vendor proposals and claims, verified their costs,
verified termination inventory and negotiated settlements with each of the subcontractors
and vendors, that encountered the same constructive and administrative changes that the
contractor did. The myriad of issues resulted in a complex termination proposal consisting
of multiple claims.
CECA met the challenges of this contractor's situation and, with its experience in heavy
construction, CPM scheduling, project management, procurement, government contracting and
claims analysis, an amicable settlement was reached.
