Contract: Construct Flood Control Levees and Structures for Lake Chautauqua
(D&M Earthmoving)

Problem: Change in Site Conditions Caused Contractor to Incur Considerable Additional Costs


D&M Earthmoving of Plymouth, Illinois, was awarded a fixed-price contract for $4,151,975 to construct a series of flood control levees and support structures. The contract was to be completed in 800 calendar days with 435 days allowed for adverse weather conditions and 365 days for construction. During the project, 9 major floods occurred totaling 631 days of flooding. The final contract duration was 1747 calendar days.

CECA prepared a series of requests for equitable adjustment (claims) in order for the contractor to recover the additional costs incurred.

D&M was compensated for the amount of additional work and extended jobsite overhead costs.
